Single User License Terms

These terms govern your use of the software and related services provided by jocapps^© GmbH, Kaiser-Joseph-Str. 254, 79098 Freiburg, Germany ("Provider"). By downloading, installing, accessing, or using the software, you agree to these terms. If you do not agree, do not use the software.

1. License Grant

Provider grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license for one natural person to use the software for lawful purposes, strictly in accordance with documentation and these terms.

2. Restrictions

No resale, renting, leasing, lending, redistribution, or hosting for third parties.
No reverse engineering, decompiling, disassembling, modifying, or creating derivative works unless mandatory law forbids this restriction.
No circumvention of license checks, technical protection, usage limits, or security controls.
No use for unlawful content, unlawful processing, or rights-infringing activities.

3. Ownership

The software is licensed, not sold. Provider and its licensors retain all rights, title, and interest, including all intellectual property rights.

4. Updates and Availability

Provider may change, suspend, or discontinue any feature, update, or service at any time, with or without notice, and has no obligation to provide maintenance, support, or future compatibility.

5. Fees, Refunds, and Cancellation

All purchases and fees are final. No refunds, credits, or partial reimbursements are owed for any reason, including non-use, reduced use, dissatisfaction, feature changes, suspension, or termination, to the fullest extent permitted by law.

6. Disclaimer of Warranties

The software is provided "as is" and "as available", with all faults and without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, accuracy, security, uninterrupted availability, or error-free operation.

7. Limitation of Liability

To the fullest extent permitted by law, Provider is not liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, revenue, data, goodwill, or business interruption. Provider's total aggregate liability arising out of or related to the software will not exceed the amount you actually paid to Provider for the software license in the twelve (12) months before the event giving rise to the claim.

8. Indemnity

You will defend, indemnify, and hold harmless Provider and its directors, officers, employees, and affiliates from and against all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or related to your use of the software, violation of these terms, or violation of any law or third-party right.

9. Term and Termination

These terms apply until terminated. Provider may suspend or terminate your license immediately at its sole discretion, with or without notice, for any reason. Upon termination, you must stop using and delete all copies of the software.

10. Governing Law and Venue

These terms are governed by the laws of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Exclusive venue for all disputes is Freiburg im Breisgau, Germany, to the extent permitted by law.

11. Changes to Terms

Provider may modify these terms at any time. Updated terms become effective upon publication. Continued use of the software after publication constitutes acceptance of the updated terms.
